Month-to-month tenancy, also known as a periodic tenancy or a month-to-month lease, is a type of rental arrangement that offers flexibility to both landlords and tenants. In Ontario, Canada, the Residential Tenancies Act (RTA) governs the rights and responsibilities of both parties in a month-to-month tenancy. As a renter, you should understand the key aspects of month-to-month tenancy to ensure a smooth and mutually beneficial rental experience.
Month-to-month tenancy is a rental agreement that automatically renews on a monthly basis. Unlike a fixed-term lease, which has a predetermined end date, a month-to-month tenancy continues indefinitely until either the landlord or the tenant provides proper notice to terminate the arrangement. In Ontario, both you and your landlords have specific notice requirements when ending a month-to-month tenancy.
The RTA outlines the following notice periods:
Landlord's Notice to Terminate: If the landlord wants to end the tenancy for reasons other than those specified in the RTA (such as personal use of the property, sale of the property, or major renovations), they must provide the tenant with 60 days' written notice.
Tenant's Notice to Terminate: If the tenant wishes to end the tenancy, they are required to provide the landlord with at least 60 days' written notice.
