How much notice is enough? ›

Consider giving two weeks' notice even if you've only been with your company for a few months. This allows time for your employer to get organized to replace your position. Give at least a two weeks' notice if you've been with your company for more than two years.

Giving one week's notice is acceptable when leaving almost all positions, although two week's notice, when possible, is preferable. Providing notice is mostly a matter of custom and a way to maintain positive, professional relationships with a former employer.

If you don't give proper notice, you will be in breach of contract and it is possible for your employer to sue you for damages. An example of this would be if they had to pay extra to get a temp to cover your work.

At present, my notice period is six weeks. However, I am open to discussing a shorter notice period to accommodate the needs of the new employer. I assure you that I am committed to fulfilling my obligations to my current organization and ensuring a smooth transition of my responsibilities.

If you don't have a written contract

If you haven't discussed a notice period and you don't have anything in writing, you should give at least 1 week's notice. If your employer insists you've agreed to longer, ask them what records they have - for example notes from a meeting where you agreed.

While you may not be legally required to give notice, most employers expect a notice of two weeks or more to help them reassign your responsibilities and hire a new employee.

Cons of a notice. The main disadvantage of a notice relates back to the fact that California is an at-will state. This means if you give two weeks notice, the employer can still go ahead and fire you before the notice period expires.

When it comes to the best day of the week to resign, most people prefer to do it on Friday. That's mainly because that way you can be free from any work-related stress over the weekend. Furthermore, employers and colleagues would have time to process your news over the weekend as well, and take them in more calmly.

Failure to Provide Reasonable Notice of Resignation

Some states, like California, do not require that an employee give any amount of reasonable notice of resignation. Other states will allow an employer to sue an employee that left without reasonable notice even if no revenue was lost.

It is the legal minimum period that your resigning employee has to give you, which is one week. It doesn't matter how long they've been with you – they still need to give one week's notice.

Unless employed under a contract, most people work under the terms of at-will employment, meaning that neither the employer or the employee has a legal obligation to give notice before terminating employment.

If you resign your job in California with at least 72 hours notice, you should receive your final paycheck on your last day of work. Otherwise, the employer has 72 hours to pay you after you give notice.
