- May the bank hold a consumer, who claims unauthorized debit card transactions were made through a lost phone, liable for some of the transaction under §1005.6(b)(2) of Regulation E (Electronic Funds Transfer Act) on the basis that he failed to report the loss of his phone—as an “access device”—within 2 days of discovering the loss?
- Is there a record retention requirement for Regulation E (Electronic Funds Transfer Act) opt-In consent forms?
- Under §1005.10(c)(1) of Regulation E (Electronic Fund Transfer Act), what if the consumer never requested that the bank stop payment but submits a claim that the transaction is unauthorized on the basis that it notified the merchant of the payment cancellation?
- Is the bank liable for authorized, but fraudulently induced, transactions by the customer?
- A consumer filed a Regulation E dispute. May the bank decline it because the customer gave a fraudster her debit card information?
